The Site is the property of VisionTek Products, Inc. and its licensors. IF YOU VISIT OR SHOP AT THE SITE, YOU ACCEPT THESE TERMS & CONDITIONS.

 

Modifications
VisionTek reserves the right to modify these Terms at any time and without any public notification. Continued use of the Site following Terms changes implies your acceptance of any and all changes. VisionTek may make changes to any products or services offered, or to the applicable prices for any such products or services, at any time, with or without notice.

All "Content", which includes but is not limited to text, graphics, interfaces, pictures, trademarks, logos, sounds, music, art, videos, and code (the design, selection, compilation, and arrangement of such Content), is protected by copyright, trademark, and various other intellectual property laws. Purchases; Other Terms & Conditions
Additional terms and conditions apply to purchases of goods or services at the Site. You agree to abide by such other terms and conditions as applicable. If there is a conflict between these Terms and the terms of sale for any goods or services offered through the Site, the latter terms shall control with respect to your purchase or use of the goods or services.

 

Accounts & Passwords
Certain services offered on or through the Site may require you to open an account (including setting up a username and password). You are responsible for maintaining the confidentiality of your account information, including your password, and for any activity that occurs under your account. You may not use anyone else's username, password, or account at any time without express consent. VisionTek Products, Inc. is not liable for any loss or damage arising from your failure to comply with these obligations.

Links & Other Third Party Content
This Site may contain links to other independent third-party web sites ("Linked Sites"). Such Linked Sites are not under VisionTek's control nor is it responsible for and does not endorse the content of such Linked Sites, including any information or materials contained on Linked Sites.

 

Site visitors may post reviews, suggestions, questions, comments, photos, and other content to the Site and associated blog provided the content is not illegal, obscene, threatening, defamatory, infringing of intellectual property rights, or otherwise injurious or objectionable to third parties. Additionally, the content must not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You agree not to use a false e-mail address, impersonate any person or entity, or otherwise mislead as to content origin when posting to the Site. VisionTek reserves the right to remove or edit such content, but cannot review all posted content.

Limitation of Liability
EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT WILL VISIONTEK BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOSS OF PROGRAMS OR OTHER DATA, EVEN IF VISIONTEK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY AGAINST VISIONTEK FOR DISSATISFACTION WITH THE SITE OR ANY CONTENT IS TO STOP USING THE SITE OR ANY SUCH CONTENT.

 

Indemnity
You agree to indemnify and hold VisionTek, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including reasonable attorneys' fees), made against VisionTek by any third party due to or arising out of or in connection with your use of the Site.

 

Information Disclosure
VisionTek may disclose any individual information we have obtained from your use of the Site if such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with VisionTek's rights or property, or the rights or property of users of the Site. We may also have to disclose personal information we have to comply with any applicable law, regulation, legal process, fraud investigation, or governmental request. Void Where Prohibited
Any offer for any feature, product or service on the Site is void where prohibited. If you choose to access the Site from outside the United States, you do so at your own risk and you are solely responsible for complying with applicable local laws. VisionTek reserves the right to limit, in its sole discretion, the provision and quantity of any Site feature, product or service to any person or geographic location.

Sales Tax

Tax Responsibility
You are responsible for any and all federal, state, and local taxes, imports, or other duties or import fees arising from the purchase of products. If you place a telephone order with us or place an order at www.visiontek.com and the order is to be shipped to a destination in the States of Illinois, California, Florida, or Texas  the law requires us to collect the applicable sales tax for all products purchased. All transactions, including returns, refunds and exchanges are performed in USD currency.


Tax Exempt

Shipping & Order Processing Information

Orders for in-stock items are processed within 48 business hours (Monday through Friday 8AM-5PM Central Time excluding National Holidays) based on payment processing time and do not include transit time.  Orders placed on Fridays from 5PM Central Time through Monday 8AM Central Time will be processed that Monday. We do not begin order processing until we receive all information needed and full payment or a full credit card authorization is obtained.

 

We reserve the right to limit order quantities of any single product and limit each order to a maximum USD amount of $2,500, except in the cases of promotions or special offers.  Each customer account is limited to one order per day to protect our customer's security from unauthorized use of payment methods.

Upon successful order processing and scheduling shipping, we will send you an email the next business day morning.

VisionTek does not deliver orders to PO Box addresses to protect our customer's security from unauthorized use of payment methods.

VisionTek reserves the right to change prices for products displayed on-line at any time and particularly to correct pricing errors. VisionTek is not responsible for typographical errors. VisionTek reserves the right to cancel any order you have placed if there was a typographical error on the Site concerning the pricing or availability of any item you ordered when you placed the order. Your total order price will include the price of the product on the day of shipping plus any applicable sales tax and shipping charges.

 

Futhermore, VisionTek reserves the right to substitute product of equal or greater value as well as products product components (eg. different colored PCBs or fans) that vary in appearance from that shown on site but do not fundamentally diminish the operation of the product.

Returns

We offer a 15-day money back guarantee on all of our products. After the 15-day period, all products will be handled under the return policy below:

 

  • No returns will be accepted without a Return Authorization Number (RMA). RMA numbers must be obtained no later than 15 days from the date the product was purchased.
  • All RMA numbers are valid for 10 days from the date of issuance. To obtain an RMA, contact VisionTek Customer Service via e-mail at support@visiontek.com This email address is being protected from spambots. You need JavaScript enabled to view it.  or by calling 866-883-5411.
  • Returns and refunds are only accepted for items purchased at www.visiontek.com
  • Please include a copy of your original invoice inside the package with the item returned circled. Items must be returned complete, unaltered, in "like new" condition, and with original product materials, documentation and packaging for full refund and to prevent the possibility of additional return fees or possible rejection of the product. It is highly suggested to use a traceable shipping method for all returned items.
  • If an item is being returned for credit, no credit will be issued until the item has been inspected and operationally tested.
  • Shipping and handling charges are not refundable. The customer is responsible for all shipping charges and insurance on all return shipments. VisionTek does not refund shipping costs on returned orders.

Any deviation from the return policy outlined above will result in a delay of your refund, additional restocking fees or refusal of your return.

Returns Inspection

All returned products will be thoroughly inspected upon receipt in accordance with our inspection criteria and a determination will be made if eligibility requirements are met for refund or replacement. The following criteria will be followed in rejecting returns and refusing credit:

 

  • Overclocking, modification, physical damage, or improper installation are not eligible for replacement or refund.
  • Packages affixed with counterfeit label(s) or affixed with labels exhibiting tampering.
  • Products with any standard certification labels removed.
  • Products or packages with barcode label removed.

VisionTek reserves the right to assess up to a 15% restocking fee on all returns and exchanges. Shipping fees are not refundable. At our discretion, credit for partial returns may be less than invoice due to reversal of special pricing discounts from qualifying bundle, instant rebate, coupon or other promotional pricing from either VisionTek or its affiliates and partners.

 

All authorized refunds will be refunded via the method of payment originally billed. Please note that refund processing may take up to two weeks following the receipt of returned goods. All refunds are subject to the financial institutions' processing timelines.

 

VisionTek does not permit the return of or offer refunds for the following products:

 

  • Product that is custom-configured/personalized to your specifications.
  • Clearance / 'Revisioned' / Open Box items
  • Opened storage solution devices
  • Non-VisionTek products
  • Bonus, Bundled, or otherwise included or purchased software
  • Data "cloning" kits and/or software

Payment Methods

VisionTek accepts the following payment methods: American Express, MasterCard, and Visa credit cards.

 

When you order by telephone and provide VisionTek with your credit card information, we will obtain a pre-approval from the credit card company for the amount of the order, which may result in a corresponding block on your available credit while the pre-approval remains in place. VisionTek will not bill your credit card or process a transaction until your order ships. If credit/debit card authorization is declined, your order is put on hold until a successful authorization is obtained. At our discretion, your order may be cancelled.

 

Some credit cards may have daily spending limits that may substantially delay the processing of your order; please contact your bank for more information. Credit card orders require billing address verification. If ship-to address is different from your billing address, this address is also subject to verification. An incorrect or unverifiable billing or ship-to address puts the order into a hold status until address is verified. At our discretion, your order may be cancelled.
